Duty relief for motor vehicles

The NSW Government will provide stamp duty relief on the replacement of motor vehicles written off due to the floods in northern NSW in January 2008. Those eligible will receive a refund on the duty paid on the replacement vehicle.

Duty relief will apply to the following Local Government Areas declared as natural disaster areas:

  • Tweed

  • Kyogle

  • Lismore

  • Richmond Valley

  • Tenterfield

  • Byron

  • Ballina

  • Clarence Valley

Conditions

Refunds will only be made where the written off vehicle being replaced was comprehensively insured and the insurance does not cover stamp duty for a replacement vehicle. Refunds only apply when duty is paid in NSW.

The amount of duty refunded will be the duty payable on the lower of:

  • the cost of the replacement vehicle, or

  • the value of the insurance payment for the vehicle written off.

Relief will not be available for cars written off that were not comprehensively insured.

Requests for refunds

Following payment of the stamp duty on the replacement vehicle applicants must:

Submit the application form to the Office of State Revenue together with:

  • a settlement letter from the relevant insurance company and

  • evidence of the cost of the replacement vehicle and

  • evidence of payment of stamp duty on the replacement vehicle.
