Mortgages and credit contracts

  • a mortgage that secures an amount not exceeding $35,000 under a consumer credit contract and no other advance, is not liable to mortgage duty

  • a mortgage that secures an amount not exceeding $35,000 under a consumer credit contract and another advance, duty is not chargeable on the mortgage in relation to the amount advanced under the consumer credit contract.
