Refunds on terminated leases

If the lease has been terminated before the commencement of the term, you can apply for a refund of the whole of the duty paid.

If the lease has been terminated early, you can apply for a refund of part of the duty paid.

A refund will be given of the difference between the duty actually paid and the duty that would have been payable if the lease had been for a term equal to the period for which the lease actually remained in force before termination.

However a refund will not be made if the lessee or an associated person occupies or proposes to occupy the premises of any time after termination.

Complete the OSR form ODA 027 for a refund of duty due to early termination.

Abolition of lease duty

Duty was abolished on lease instruments first executed on or after 1 January 2008. The abolition of duty on leases does not affect any obligation to pay duty in respect of a lease instrument and a variation of a lease instrument executed before 1 January 2008.
