Public sector requirements
All NSW Public Sector Superannuation Funds are required by law to remit unclaimed money to OSR. The power to collect and repay unclaimed superannuation was established by the Commonwealth under Section 18 of the Superannuation (Unclaimed Money & Lost Members) Act 1999.
OSR collects unclaimed superannuation benefits in accordance with the Unclaimed Money Act 1995. The Act also provides details for the collection of information from superannuation providers including provision of tax file numbers.
Similar to other types of unclaimed money, unclaimed superannuation benefits are transferred to OSR to hold in trust for the rightful owner.
OSR has the responsibility for publishing unclaimed money information either on its website or in the NSW Government Gazette. OSR repays the money to the owner where proof of ownership is established.
