Where the application is being made by the person entitled to the land based on the laws of intestacy, the consent by the legal personal representative to the application is liable to a fixed duty of $50. See Section 63(b) of the Duties Act.
To determine whether or not the applicant is entitled on intestacy see section 61B of the Probate & Administration Act 1898.
Supporting information
A statutory declaration by the administrator of the estate setting out the entitlements to the land must be furnished when submitting the documents for stamping.
In the case of self assessment by an EDR client, the statutory declaration must be retained on file.
